BioMarin and Ascendis Pharma settle patent fight over CNP therapies
The license deal, effective August 28, 2026, ends litigation over TransCon CNP, navepegritide and Yuviwel with royalty payments through May 2030

BioMarin Pharmaceutical and Ascendis Pharma A/S have settled all pending patent litigation between the two companies with prejudice. The agreement, effective August 28, 2026, gives Ascendis a non-exclusive, worldwide license to BioMarin's patents covering TransCon CNP, navepegritide and Yuviwel.
In exchange, BioMarin will collect royalties of 20% of annual net sales in the United States and 18% in the European Union, Brazil and South Korea. The payments run from the first commercial sale in each territory until May 2030.
The settlement ends a multi-year patent dispute over CNP-based therapies, replacing legal costs and an uncertain outcome with a defined royalty stream for BioMarin and removing an overhang that had shadowed Ascendis's TransCon CNP franchise and Yuviwel. The deal follows BioMarin's acquisition of Amicus Therapeutics in April 2026, whose former chief executive went on to lead Travere. Together, the moves point to a pattern at BioMarin of consolidating rare-disease assets through acquisitions and litigation settlements rather than prolonged court battles.
